| SUBJECT: | Chapter 60 of the Laws of 2000 Relating to Special Class Sizes for Students with Disabilities |
Chapter 60 of the Laws of 2000 was signed into law on May 15, 2000. This law affects special class sizes for students with disabilities as follows:
In accordance with section 4402(6) of the Education Law, the New York City School Districts authority to increase class sizes in special classes containing students with disabilities to obtain relief from any adverse fiscal impact from under-utilization of special education resources due to low student attendance in special education classes at the middle and secondary levels expires as of June 30, 2000. Accordingly, section 200.6(g)(6)(iii) of the Regulations of the Commissioner is no longer applicable to the school district of the City of New York. Effective July 1, 2000, all special class sizes for students with disabilities in New York City must be in compliance with the class sizes specified in section 200.6(g)(4) of the Regulations of the Commissioner.
All other boards of education of a city school district with a population of 125,000 inhabitants or more continue to be authorized to increase special class sizes containing students with disabilities whose age ranges are equivalent to those of students in middle and secondary schools during the 2000-2001 school year in accordance with section 4402(6) of the Education Law (over-enrollment due to low student attendance).
All school districts with a population of less than one million inhabitants may implement a special class size variance by notification, in accordance with section 4402(2)(d) of the Education Law, until June 30, 2001.
