SUBJECT: Application for Exception to the One Percent Cap on Proficient or Above Scores Based on Alternate Achievement Standards
Attached is the application by which the New York State Education Department (NYSED) will grant an exception to a local educational agency (LEA), permitting it to exceed the 1.0 percent cap in counting as proficient and advanced for school accountability the scores of students with the most significant cognitive disabilities based on alternate academic achievement standards. Only LEAs, including Charter Schools and Special Act School Districts, that are subject to the New York State System of Accountability for Student Success (SASS) and that are able to document extraordinary circumstances should submit this application. LEAs that were approved to exceed the cap last year for the 2004-05 school year need not reapply, unless they wish to seek a change to what was approved.
LEAs where it would take only one student at each grade level to exceed the 1.0 percent cap will automatically receive an exception. Such schools and districts do not need to complete this application except in situations where such schools have more than one student due to other extenuating circumstances that would cause it to exceed the 1.0 percent cap.
Completed applications must be received by April 16, 2005 for consideration of exceptions for the 2004-05 school year. Questions regarding this application may be directed to Patricia Geary in the Special Education Policy and Partnerships Unit at 518-473-2878.
