Additional data collection and reporting requirements are added to federal law, including reporting on:

• Percentages of students with disabilities by race, ethnicity, limited English proficiency status, gender and disability category; and

• The incidence and duration of disciplinary actions by race, ethnicity, limited English proficiency status, gender and disability category for suspensions of one day or more.

Disproportionality

• The incidence duration and type of disciplinary actions, including suspensions and expulsions, based on race and ethnicity must be collected.

• If a LEA is found to have significant disproportionality, it must:

• review and revise, if appropriate, its policies, procedures and practices;

• use its federal funds to provide comprehensive, coordinated early intervening services for these groups that were significantly overidentified; and

• publicly report on the revision of policies, practices and procedures that are required.
