Additional data collection and reporting requirements are added to federal law, including reporting on:
Percentages of students with disabilities by race, ethnicity, limited English proficiency status, gender and disability category; and
The incidence and duration of disciplinary actions by race, ethnicity, limited English proficiency status, gender and disability category for suspensions of one day or more.
Disproportionality
The incidence duration and type of disciplinary actions, including suspensions and expulsions, based on race and ethnicity must be collected.
If a LEA is found to have significant disproportionality, it must:
review and revise, if appropriate, its policies, procedures and practices;
use its federal funds to provide comprehensive, coordinated early intervening services for these groups that were significantly overidentified; and
publicly report on the revision of policies, practices and procedures that are required.
