The statute clarifies that the screening of a student by a teacher or specialist to determine appropriate instructional strategies for curriculum implementation are not considered to be an evaluation for eligibility for special education, therefore consent is not required.
The statute prohibits reevaluations more than once per year, unless the parent and the LEA agree otherwise. Reevaluations must occur every three years unless the parent and the LEA agree a reevaluation is unnecessary.
