IDEA makes substantive changes to the requirements relating to child find, the provision of special education services and the calculation and use of the proportionate amount of federal funds for students who are enrolled in private schools by their parents, including religious schools. (These provisions do not apply to approved private schools for students with disabilities in New York State).
The school district where the private school is located has responsibility to conduct child find activities, expend the proportionate amount of federal funds on services to such students, after timely and meaningful consultation with representatives of private school and maintain records on the number of students evaluated, the number of students determined to be students with disabilities, and the number of students with disabilities served.
State and local funds may supplement and in no case supplant the proportionate amount of federal funds to be expended for students with disabilities attending private schools.
The child find requirements must be designed to ensure the equitable participation of parentally placed private school students with disabilities and provide an accurate count of such children and be similar to child find activities undertaken for the LEA's public school students.
