Rulemaking
A new section on State Administration has been added relating rulemaking that requires States to ensure that any State rules, regulations and policies relating to IDEA conform to the purposes of the Act and must identify, in writing, to local educational agencies (LEAs) located in the State and to the Secretary any rule, regulation or policy as a State-imposed requirement that is not required by IDEA and federal regulations. Each State is required to minimize the number of rules, regulations and policies to which the LEAs and schools located in the State are subject to under IDEA.
Support and Facilitation
State rules, regulations and policies under IDEA must support and facilitate LEA and school-level system improvement designed to enable students with disabilities to meet the challenging State student academic achievement standards.
