Final Federal Regulations to Implement the Individuals with Disabilities Education Act (IDEA 2004) |
The final regulations to implement IDEA 2004, also commonly known as Part 300 of the Code of Federal Regulations, were issued in the Federal Register on August 14, 2006 and become effective on October 13, 2006. These federal regulations can be found at: http://idea.ed.gov.
Effective October 13, 2006, school districts are required to implement the new requirements of the federal regulations. In addition, existing State law and regulations must continue to be implemented to the extent consistent with federal requirements. A separate memorandum will be issued regarding the provision of special education services to students with disabilities enrolled in nonpublic schools by their parents.
The United States Department of Education (USDOE) has informed states that their laws and regulations to implement IDEA 2004 must be in effect by June 30, 2007. In January 2007, the Department will be discussing with the Board of Regents proposed changes to Part 200 of the Regulations of the Commissioner of Education. Public hearings will be scheduled after the Board of Regents meeting.
