The Office of Vocational and Educational Services for Individuals with Disabilities (VESID) of the New York State Education Department will provide an opportunity for public comment on the proposed amendments to the Rules of the Board of Regents and the Regulations of the Commissioner of Education relating to behavioral interventions. The proposed regulations were adopted at the June 2006 meeting of the Board of Regents as an emergency action, effective June 23, 2006. These regulations: establish general standards for behavioral interventions, including assessments of student behavior, behavioral intervention plans, the use of time out rooms and emergency physical interventions; set a general prohibition on the use of aversive behavioral interventions, with a provision and procedures for a child-specific exception to this prohibition; and establish standards for programs that provide aversive behavioral interventions as approved on a child-specific basis.
New Requirements For Behavioral Intervention Plans, Including The Use Of Aversive Behavioral Interventions is a memorandum which summarizes the regulations.
Amendments to the Regulations of the Commissioner of Education
Preregistration is not required. However, if you require special accommodations such as a sign language interpreter, you must notify Carol Northrup by e-mail at cnorthru@mail.nysed.gov or by telephone at 518-473-2878 no later than August 3, 2006.
NOTE: You must bring photo identification, obtain and wear a visitor badge and follow sign-in procedures, which may include a security scanning, as required at the door.

All individuals seeking to provide oral comment must so indicate upon registration at the site of the hearing. Individuals providing oral public comment will be limited to a maximum of three (3) minutes each. VESID requests, but does not require, that individuals wishing to make oral comments at the public hearing also provide comment in written format. Sites open 30 minutes prior to the start of the meeting. Individuals wishing to provide oral comment are encouraged to arrive early.
The rules of public hearings will be reviewed and a brief summary of the proposed regulations will be provided.
