In accordance with Section 4408 of the New York State Education Law, the State Education Department (SED) must review and approve requests for reimbursement of extended school year (July/August) special education programs and/or services which now include requests for approval of new Special Class programs and/or new or continuing Non-Special Class programs for school-age students with disabilities. Prior approval by the Department is required for districts to be eligible for reimbursement of public funds.
Failure to submit an application for either program and/or failure to receive approval will result in no reimbursement of public funds being provided by SED. In addition, no public funds will be reimbursed retroactively to an agency if it operated a program/service(s) without prior approval by the Department.
Please note: Beginning with the 2007 July/August extended school year, there are new procedures that require the submission of separate Application forms for school districts seeking approval for new Special Class full-day and/or half-day special education programs and/or new or continued approval to operate Non-Special Class programs. The new procedure for the approval of Non-Special Class programs requires the annual submission of a completed Application form for review and approval for each Non-Special Class Program a district proposes to operate during a July/August extended school year.

If your agency wishes to propose a new July/August 2007 extended school year
program, SED must receive each completed application by Friday, May
11, 2007,to allow sufficient time for review of the application
by Department staff.
