Question: Is effective general supervision of the implementation of the Individuals with Disabilities Education Act ensured through the State Education Agency’s (SEA) utilization of mechanisms that result in all eligible children with disabilities having an opportunity to receive a free appropriate public education (FAPE) in the least restrictive environment (LRE)?

Probe GS.VI:

State Goal:

All eligible children with disabilities will have the opportunity to receive a free appropriate public education (FAPE) in the least restrictive environment (LRE) through the State Educational Agency’s (SEA) utilization of mechanisms of effective general supervision and implementation of the Individuals with Disabilities Education Act.

  1. Targets (by June 30, 2003)
    (for reporting period July 1, 2002 through June 30, 2003):
  • Develop a brochure for parents on resolving concerns about their child’s special education services.
  • Revise and publish the State mandatory Procedural Safeguards Notice.
  • Provide materials to families whose primary language is not English in four different languages (Spanish, Russian, Chinese and Haitian-Creole), including a Parent’s Guide and Procedural Safeguards Notice.
  • Amend Part 200 Regulations to ensure timely impartial hearings.
  1. Explanation of Progress or Slippage
    (for reporting period July 1, 2002 through June 30, 2003):
  • Five specific publications were developed and disseminated regarding due process by March 2002.
  • The Parent’s Guide and the Procedural Safeguards Notice were provided in four different languages for parents whose primary language is not English.
  • Part 200 Regulations were amended to ensure timely impartial hearings.
  • The Procedural Safeguards Notice was revised in August 2003.
  1. Projected Targets
    (for next reporting period July 1, 2003 through June 30, 2004):
  • 100 percent of New York State laws, regulation and policy will be consistent with federal laws, regulation and policy.
  • 100 percent of publications articulating laws, regulation and policy will be posted on VESID’s website.
  1. Future Activities
  2. Projected Timelines and Resources
    (for next reporting period July 1, 2003 through June 30, 2004 and on going):
  • Further regulatory amendments will be discussed by the Board of Regents to ensure timely impartial hearings in September 2003. Approval is slated for February 2004.
  • The Board of Regents will discuss regulatory amendments to Parts 276 and 279 (State Review Office) in November 2004. Approval is slated for December 2003.
  • Develop required Notices and Forms for the field by May 2004.
  • Update the Procedural Safeguards Notice to be consistent with any regulatory or statutory changes.
