Chapter 405 of the Laws of 1999 required
the State to identify school districts that had one or more of the
seven problems listed below, verify data, determine underlying
causes, provide technical assistance and prepare an annual report to
the legislature.
- High rate of classification
- Low rate of declassification of
preschool students with disabilities
- Low rate of declassification of
school-age students with disabilities
- High rate of placing students with
disabilities in separate settings
- Disproportionality in
identification of students as disabled or identification by a
particular disability
- Disproportionality in placement of
preschool students in separate settings
- Disproportionality in placement of
school-age students in more restrictive settings
In the first notification that was
completed during the 2000-01 school year, 364 school districts were
notified that they had one or more of the issues listed above. In
the second notification, completed during the 2002-03 school year,
353 school districts were notified as having one or more issues. All
together 450 school districts were notified about Chapter 405 issues
in one or both years. Based on data analysis, the same thirteen
school districts were assigned the most intensive "Targeted"
technical assistance both years. "Regional" technical assistance was
assigned to 85 school districts in 2000-01 and to 89 school
districts in 2002-03. "Self" review was assigned to 266 school
districts in 2000-01 and to 251 school districts in 2002-03.
